Terms of Service
Loma Dynamics, Inc. ("Loma," "we," "us," or "our") is a Delaware corporation and operates the Loma mobile application, website, and any related services (the "App"). By installing, accessing, or using the App, you agree to these Terms of Service ("Terms"). If you do not agree, do not use the App.
01What Loma Is
Loma is a consumer health literacy tool. It translates the data you provide — whether typed in, dictated, ingested from a connected wearable, or pulled from a third-party nutrition app — into plain-language summaries, insights, suggestions, and informational content. Loma is not a medical device, a diagnostic tool, a clinical decision-support system, a fitness coach, a registered dietitian, a licensed therapist, or any other form of credentialed care.
Loma does not replace professional medical advice. Always consult a qualified health professional before making decisions based on anything you see in the App, especially when those decisions involve diet, exercise, sleep, mental health, supplementation, medication, or any condition you are treating.
02Your Account and Eligibility
You must be at least 16 years old to create an account. By using the App you confirm that the information you provide is accurate, that you are using the App on your own behalf, and that you have the legal right to share any data — including data forwarded from third-party services — that flows into the App through your connected integrations.
You are responsible for keeping your account credentials secure and for all activity that occurs on your account.
03Dependence on Integrated Data and Input Accuracy
The output Loma produces — recommendations, summaries, ledgers, insights, citations, action cards, charts, and any other generated content — depends entirely on the data the App receives. That data may come from:
- You directly — meal logs, exercise logs, hydration entries, sleep notes, goals, preferences, dietary restrictions, allergies, equipment access, voice dictation, photographs of food, free-text descriptions, and any other input you provide.
- Wearables and connected services — Apple Health, Whoop, Oura, Garmin, Eight Sleep, MyFitnessPal, MacroFactor, Strava, and similar third-party providers that you authorize.
- Inferences and synthesis — Loma combines the above with statistical models, large-language-model summarization, and a curated content library to produce its output.
You acknowledge and agree to all of the following:
- Loma is not responsible for the results you experience while using the App. Outcomes — including weight, body composition, sleep quality, training adaptations, performance metrics, mood, energy levels, recovery, or any other personal result — depend on factors Loma cannot observe, verify, or control, including the completeness of your inputs, the accuracy of your wearables, your physiology, your environment, and your adherence to any plan you choose to follow.
- Loma does not guarantee that data forwarded by third parties is accurate, current, or complete. Wearable hardware drifts, calibrations vary, sync gaps occur, manufacturers change algorithms without notice, and third-party apps may overwrite or delete data outside our control. Loma reads what those integrations report; we cannot validate it.
- You are responsible for the accuracy of every input you provide. If you mislogged a meal, misreported your weight, skipped a workout entry, dictated an unclear voice note, or provided incomplete dietary restrictions, the App's output will reflect that. We do our best to flag obvious inconsistencies but cannot detect every input error.
- Loma's output is informational and educational, not prescriptive. Even when the App phrases a suggestion in direct language ("eat 30g protein in the next hour," "try a 30-minute easy run today," "consider a 10-minute breathing practice tonight"), that suggestion is a starting point for your own judgment, not an instruction.
04No Liability for Food, Exercise, Mindfulness, or Sleep Recommendations
To the maximum extent permitted by law, Loma is not liable for any harm — including injury, illness, allergic reaction, anaphylaxis, food poisoning, foodborne illness, gastrointestinal distress, allergic contact reaction, intolerance flare-up, muscle strain, joint injury, soft-tissue injury, bone injury, cardiac event, fainting, dizziness, dehydration, hyponatremia, overtraining injury, eating-disorder relapse, sleep disturbance, anxiety, depressive episode, panic attack, dissociation, or any other physical, mental, emotional, or financial harm — arising out of or related to:
- Any food, ingredient, recipe, meal plan, supplement, or dietary suggestion the App surfaces, generates, or includes in any list of options.
- Any exercise, workout, training plan, mobility routine, stretching routine, intensity zone, equipment recommendation, sport, or activity suggestion the App surfaces or generates.
- Any mindfulness, breathwork, meditation, journaling, gratitude, relaxation, or stress-reduction practice the App surfaces or generates.
- Any sleep recommendation, schedule suggestion, wind-down routine, environment change, supplement, or sleep-tracking interpretation the App surfaces or generates.
- Any insight, callout, hero copy, panel, chat response, action card, push notification, citation, or other piece of generated content that touches on the above.
This includes situations where:
- You have an allergic reaction (mild, moderate, severe, or fatal) to a food, ingredient, or supplement that the App recommended, listed, mentioned, ingredient-tagged, or failed to warn about.
- You experience food poisoning or any foodborne illness from a meal you prepared, ordered, or consumed in connection with content the App surfaced.
- You are injured during or after a workout, training session, sport, mobility routine, or activity that the App recommended, suggested, generated, or referenced — including overtraining, undertraining, improper form, equipment failure, environmental conditions, or any other proximate cause.
- You experience a mental-health adverse event during or after a mindfulness, breathwork, journaling, or sleep practice the App recommended or referenced.
- You experience worsened sleep, insomnia rebound, circadian disruption, or any other sleep-related adverse outcome from following or interpreting any sleep-related content the App produced.
You acknowledge that you provide your own dietary restrictions, allergies, intolerances, religious dietary rules, disliked sports, and equipment-access information to the App. While Loma uses that information to filter and shape its recommendations, Loma cannot guarantee that every generated suggestion will perfectly respect every constraint, and Loma is not liable when a suggestion conflicts with information you provided. You remain solely responsible for reviewing any suggestion before acting on it.
You agree to consult an appropriately credentialed professional — physician, registered dietitian, licensed therapist, certified personal trainer, sleep specialist, or other qualified expert — before making changes to your diet, exercise routine, mental-health practice, sleep routine, or medication regimen based on App content.
05Third-Party Integrations
The App connects to third-party wearable, nutrition, and activity services. Your use of those services is governed by their own terms and privacy practices, not Loma's. Loma is not responsible for the availability, accuracy, completeness, security, or legal compliance of any third-party service. We may add, remove, or modify integrations at any time without notice.
When you authorize a connection, you grant Loma permission to read and synchronize the data the third party makes available. You can revoke that permission at any time in the App's Settings, in the third party's own settings, or in your device's permissions.
06Subscriptions, Trials, and Billing
Some App features may require a subscription. Pricing, billing cycle, renewal terms, and refund policy are shown at the point of purchase and managed through the App Store. Loma does not directly process subscription payments; the App Store does. To cancel, manage your subscription through your App Store account.
07Acceptable Use
You agree not to:
- Use the App in any way that could harm yourself or others.
- Reverse engineer, decompile, or attempt to extract the App's source code or models.
- Use the App to provide professional medical, dietetic, training, or mental-health services to third parties without independent licensing.
- Submit content you do not have the legal right to share.
- Attempt to circumvent the App's safety guardrails, prompt-validation gates, or any other moderation systems.
- Use the App to generate, distribute, or amplify health misinformation.
We may suspend or terminate your account if you violate these rules.
08Intellectual Property
Loma and its licensors own the App, including its design, code, content library, voice canon, brand assets, and any generated copy. You receive a limited, revocable, non-transferable license to use the App for personal, non-commercial purposes. You retain ownership of the personal data you submit; Loma's use of that data is governed by our Privacy Policy.
09Disclaimers
The App and all content it produces are provided "as is" and "as available" without warranty of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or completeness. Loma does not warrant that the App will be uninterrupted, error-free, secure, or free of viruses or other harmful components. Loma does not warrant the accuracy of any recommendation, insight, citation, or generated output.
10Limitation of Liability
To the maximum extent permitted by law, Loma's total cumulative liability arising out of or related to these Terms or your use of the App shall not exceed the greater of (a) the amount you paid to Loma in the twelve months preceding the event giving rise to the claim or (b) US $100.
Loma shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, loss of data, loss of goodwill, or loss of business, even if advised of the possibility of such damages.
Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for fraud, gross negligence, or death or personal injury caused by gross negligence where local law prohibits such limitation.
11Indemnification
You agree to defend, indemnify, and hold harmless Loma, its officers, employees, contractors, and licensors from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your use of the App, (b) your violation of these Terms, (c) your violation of any third-party right, or (d) any inaccurate, incomplete, or misleading information you provide to the App.
12Termination
You may stop using the App at any time. You may delete your account from the in-app Settings or by contacting us. Loma may suspend or terminate your account at any time, with or without cause and with or without notice, if we believe you have violated these Terms.
Upon termination, your right to use the App ceases. Provisions that by their nature should survive — including Sections 3, 4, 8, 9, 10, 11, and 14 — will survive.
13Changes to These Terms
We may modify these Terms from time to time. When we make material changes, we will notify you in the App and update the "Last updated" date above. Continued use of the App after the effective date of the updated Terms constitutes acceptance.
14Governing Law and Disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms or the App shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts.
If you are a consumer in the European Union, the United Kingdom, or another jurisdiction whose mandatory consumer-protection laws override the foregoing, you may also have rights under your local law.
