Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Loma mobile application, the website at lomadynamics.com, beta waitlist signup, and any related services we operate (collectively, the "Services"). By installing, accessing, or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

01What Loma Is — and Is Not

Loma is a consumer wellness and health-literacy tool. It translates data you provide — typed, dictated, photographed, synced from wearables, or imported from third-party apps — into plain-language summaries, balance reads, insights, suggestions, and informational content.

Loma is not a medical device, diagnostic tool, clinical decision-support system, telehealth service, fitness coach, registered dietitian, licensed therapist, or any other form of credentialed care. Loma is not a HIPAA-covered entity or business associate unless we expressly agree otherwise in writing.

Loma does not provide medical advice. Always consult a qualified health professional before making decisions based on anything you see in the Services, especially when those decisions involve diet, exercise, sleep, mental health, supplementation, medication, pregnancy, chronic conditions, or treatment plans.

02Eligibility and Account Responsibility

You must be at least 16 years old to create an account or use the App. If you are 16 or 17, you represent that a parent or legal guardian has reviewed these Terms and the Privacy Policy and permits your use.

By using the Services you confirm that:

• The information you provide is accurate to the best of your knowledge
• You are using the Services on your own behalf (or with guardian permission as above)
• You have the legal right to share any data — including data from third-party integrations — that flows into the Services through your connections

You are responsible for safeguarding your account credentials and for all activity under your account. Notify us promptly at hello@lomadynamics.com if you suspect unauthorized access.

03Beta Program and Early Access

Loma may be offered in private or public beta. Beta features may be incomplete, change without notice, contain bugs, or be withdrawn. Beta software is provided for evaluation only and may not meet the reliability or availability standards of a general release.

By joining the beta waitlist or accepting a beta invitation, you agree that:

• We may contact you at the email you provide with beta updates
• Feedback you choose to share may be used to improve the Services without compensation
• We may modify or end the beta at any time
• Your access may be limited, throttled, or revoked at our discretion

Waitlist signup is governed by our Privacy Policy. Submitting your email does not guarantee admission to the beta.

04Website Use

You may browse our marketing website and submit a beta request without creating an App account. You agree not to:

• Scrape, crawl, or harvest data from the site by automated means without permission
• Attempt to disrupt site security or infrastructure
• Misrepresent your identity or affiliation
• Use the site for unlawful purposes

Website content, branding, and design are owned by Loma or its licensors and may not be copied or exploited without permission except as allowed by law.

05Dependence on Integrated Data and Input Accuracy

Output the Services produce — recommendations, summaries, balance ledgers, insights, citations, action cards, charts, chat responses, and any other generated content — depends entirely on the data the Services receive. That data may come from:

• You directly — meal logs, exercise logs, hydration entries, sleep notes, goals, preferences, dietary restrictions, allergies, equipment access, voice dictation, photographs of food, free-text descriptions, and other input
• Wearables and connected services — Apple Health, Whoop, Oura, Garmin, Eight Sleep, Fitbit, Google Fit, Samsung Health, MyFitnessPal, MacroFactor, Strava, Peloton, Nike Run Club, and similar providers you authorize
• Automated synthesis — statistical models, large-language-model summarization, retrieval from a curated content library, and safety validators

You acknowledge and agree:

• Loma is not responsible for results you experience. Outcomes depend on factors we cannot observe or control, including input completeness, wearable accuracy, physiology, environment, and whether you follow any suggestion.
• Third-party data may be wrong or incomplete. Hardware drifts, sync gaps, algorithm changes, and third-party app edits occur outside our control. We read what integrations report; we cannot independently verify device data.
• You are responsible for input accuracy. Mislogged meals, incomplete allergy lists, unclear voice notes, and outdated weight entries affect output. We flag some inconsistencies but cannot catch every error.
• Output is informational, not prescriptive. Direct-sounding language ("eat 30g protein," "try an easy 30-minute run," "take four minutes to wind down") is a starting point for your judgment, not an instruction.

06No Liability for Food, Exercise, Mindfulness, or Sleep Content

To the maximum extent permitted by law, Loma is not liable for any harm — including injury, illness, allergic reaction, anaphylaxis, food poisoning, foodborne illness, gastrointestinal distress, intolerance flare-up, muscle or joint injury, cardiac event, fainting, dehydration, overtraining injury, eating-disorder relapse, sleep disturbance, anxiety, depressive episode, panic, dissociation, or any other physical, mental, emotional, or financial harm — arising from or related to:

• Any food, ingredient, recipe, meal plan, supplement, or dietary suggestion the Services surface or generate
• Any exercise, workout, training plan, mobility routine, intensity zone, equipment recommendation, or activity suggestion
• Any mindfulness, breathwork, meditation, journaling, or stress-reduction practice
• Any sleep recommendation, schedule suggestion, wind-down routine, or sleep-tracking interpretation
• Any insight, panel, chat response, action card, notification, citation, or other generated content touching the above

This includes harm where:

• You react to a food, ingredient, or supplement the Services recommended, listed, or failed to flag relative to constraints you provided
• You become ill from food prepared or consumed in connection with Service content
• You are injured during or after activity the Services recommended or referenced
• You experience a mental-health adverse event during or after a mindfulness or sleep practice the Services referenced
• Sleep worsens after following or interpreting sleep-related content

You provide dietary restrictions, allergies, intolerances, religious rules, disliked sports, and equipment access. While Loma uses that information to filter suggestions, we cannot guarantee every output respects every constraint. You remain solely responsible for reviewing suggestions before acting.

Consult an appropriately credentialed professional before changing diet, exercise, mental-health practices, sleep routines, or medications based on Service content.

07AI-Generated Content

Parts of the Services use artificial intelligence and automated systems. AI output may be inaccurate, incomplete, outdated, or poorly suited to your circumstances. Do not rely on AI responses for medical emergencies, crisis intervention, diagnosis, or treatment decisions.

Loma employs automated safety measures — including crisis keyword routing, citation checks, allergen-aware filtering, and voice gates — but no automated system is perfect. If you are in crisis or may harm yourself or others, contact local emergency services immediately. In the United States, you can call or text 988 for the Suicide & Crisis Lifeline. Loma's crisis routing is designed for U.S. resources and may not reflect local services in other countries.

08Third-Party Integrations and Platforms

The Services connect to third-party wearable, nutrition, activity, and health-platform services. Your use of those services is governed by their own terms and privacy practices. Loma is not responsible for their availability, accuracy, security, or legal compliance. We may add, remove, or modify integrations at any time.

When you authorize a connection, you grant Loma permission to read and synchronize data the third party makes available. Revoke access in Loma Settings, the third party's settings, or your device permissions.

Apple Health / HealthKit. If you connect Apple Health, you acknowledge that Loma's use of HealthKit data is limited to providing the Services and is governed by Apple's developer terms. HealthKit data is not used for advertising or sale.

App stores. If you download the App through the Apple App Store or Google Play, their terms also apply. For iOS, Apple's standard end-user license agreement applies to the extent required by Apple.

09Subscriptions, Trials, and Billing

Some features may require a paid subscription. Pricing, billing cycle, renewal, free-trial terms, and refunds are shown at purchase and processed by the Apple App Store or Google Play (not directly by Loma). Manage or cancel subscriptions through your store account settings.

If a subscription price changes, the store will notify you according to its rules. We may change which features require payment at any time.

10Acceptable Use

You agree not to:

• Use the Services in a way that could harm yourself or others
• Reverse engineer, decompile, or attempt to extract source code, models, or non-public APIs except where law expressly permits
• Provide professional medical, dietetic, training, or mental-health services to third parties using Loma without independent licensing
• Submit content you lack rights to share, including others' health data without authorization
• Circumvent safety guardrails, validators, rate limits, or access controls
• Probe or disrupt our infrastructure
• Use the Services to generate, distribute, or amplify health misinformation
• Use the Services in violation of export-control or sanctions laws

We may suspend or terminate access if you violate these rules or if we reasonably believe your use creates risk to you, us, or others.

11Intellectual Property

Loma and its licensors own the Services, including software, design, content library, voice canon, trademarks, and generated copy (excluding your personal data). You receive a limited, revocable, non-exclusive, non-transferable license to use the Services for personal, non-commercial purposes.

You retain ownership of personal data you submit. Our use of that data is governed by the Privacy Policy. Feedback you voluntarily provide may be used without restriction or compensation.

12Disclaimers

THE SERVICES AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR COMPLETENESS. LOMA DOES NOT WARRANT UNINTERRUPTED, ERROR-FREE, OR SECURE OPERATION OR THE ACCURACY OF ANY RECOMMENDATION, INSIGHT, OR GENERATED OUTPUT.

Some jurisdictions do not allow certain disclaimers; in those jurisdictions, disclaimers apply to the fullest extent permitted.

13Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• LOMA'S TOTAL CUMULATIVE LIABILITY ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID LOMA FOR THE SERVICES IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) US $100.
• LOMA SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA, GOODWILL, OR BUSINESS, EVEN IF ADVISED OF THE POSSIBILITY.

Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for fraud, intentional misconduct, or death or personal injury caused by gross negligence where limitation is prohibited.

14Indemnification

You agree to defend, indemnify, and hold harmless Loma, its officers, directors, employees, contractors, and licensors from claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from (a) your use of the Services, (b) your violation of these Terms, (c) your violation of any third-party right, or (d) inaccurate or misleading information you provide.

15Termination

You may stop using the Services at any time. You may delete your App account from in-app Settings or by contacting hello@lomadynamics.com. Deletion is described in our Privacy Policy.

We may suspend or terminate your access at any time, with or without notice, if we believe you violated these Terms or pose a risk to the Services or others.

Upon termination, your license ends. Sections that by their nature should survive — including Sections 5, 6, 7, 11, 12, 13, 14, 17, and 18 — survive.

16Changes to These Terms

We may modify these Terms from time to time. When we make material changes, we will notify you in the App, by email where appropriate, or by posting updated Terms with a revised "Last updated" date. Continued use after the effective date constitutes acceptance where permitted by law. If you do not agree, stop using the Services and delete your account.

17Governing Law, Disputes, and Consumer Rights

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles, except where mandatory consumer-protection law in your country of residence requires otherwise.

Informal resolution. Before filing a claim, contact hello@lomadynamics.com and allow 30 days for us to try to resolve the dispute informally.

Courts. Except where prohibited by applicable law, exclusive jurisdiction for disputes arising from these Terms or the Services lies in the state or federal courts located in Delaware, and you consent to personal jurisdiction there.

Consumer carve-outs. If you are a consumer in the European Union, United Kingdom, or another jurisdiction with mandatory consumer protections, you may have rights to bring claims in your home country and benefit from local mandatory rules. Nothing in these Terms limits non-waivable rights under those laws.

Class actions. Where permitted by law, disputes are brought only on an individual basis, not as a plaintiff or class member in a class, consolidated, or representative action. If this waiver is unenforceable in your jurisdiction, it does not apply to you.

18General Provisions

• Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and Loma regarding the Services.
• Severability. If any provision is unenforceable, the remainder stays in effect.
• No waiver. Failure to enforce a provision is not a waiver.
• Assignment. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets.
• Force majeure. We are not liable for delays or failures due to events beyond our reasonable control.
• Export. You may not use or export the Services except as authorized by U.S. and local export laws.
• Language. These Terms are in English. Translations are for convenience only; the English version controls to the extent permitted.
